1. Who we are
Musicalism (“Musicalism,” “we,” “us,” or “our”) is a music curation studio that designs sonic identities for hospitality venues and operates the Music2Play app for in-venue playback. This Privacy Policy applies to www.themusicalism.com (the “Site”) and the Music2Play mobile and tablet applications (the “App”), together referred to as the “Services.”
2. Information we collect
We collect only the information needed to operate the Services and to respond to you. The categories are:
Information you give us
- Contact details you submit through our consultation form or by emailing us — typically name, venue name, email, phone number, and any message you send.
- Account information if you create an account in the App — your email address, a display name, and the venue or workspace you belong to.
- In-app preferences such as the playlists you select, scheduling choices, favourites, and playback volume.
Information collected automatically
- Device & technical data — device model, operating system version, app version, language, time zone, and a randomly generated device identifier used to keep you signed in.
- Usage data — pages or screens viewed, features used, playback events (track started, skipped, paused), and approximate session duration. We use this to fix bugs and improve the product.
- Diagnostic & crash reports — when the App crashes or hits an error, we receive a technical report that helps us diagnose the issue.
- Cookies & similar technologies on the Site — used for essential functionality and anonymous analytics. You can disable cookies in your browser.
What we do not collect
We do not collect microphone audio, contacts, photos, health data, financial account details, or precise location. The App does not access your camera, microphone, or contacts. We do not sell personal information, and we do not use your data for advertising.
3. How we use your information
We use the information we collect to:
- Provide, operate, and maintain the Services.
- Authenticate you, keep you signed in, and remember your preferences.
- Stream and schedule licensed music playback inside the App.
- Respond to your inquiries, consultation requests, and support messages.
- Send service-related communications (account confirmations, important changes, security notices). We do not send marketing emails unless you opt in.
- Diagnose problems, prevent abuse, and improve performance and reliability.
- Comply with legal obligations and enforce our terms.
4. Legal bases (EEA / UK users)
If you are in the European Economic Area or the United Kingdom, we process your personal data on the following legal bases: performance of a contract (to provide the Services you’ve requested), our legitimate interests (to run and improve our business in ways you would reasonably expect), your consent (where required, such as for non-essential cookies), and compliance with our legal obligations.
5. How we share information
We do not sell your personal information. We share information only with the limited set of parties below, and only as needed to deliver the Services:
- Service providers that host our infrastructure, deliver emails, process crash reports, and provide analytics. They act on our instructions under written agreements.
- Music rights administrators where required, to report playback usage in line with the licences that allow your venue to play music legally.
- Legal & safety — when required by law, subpoena, or to protect the rights and safety of users and the public.
- Business transfers — if Musicalism is involved in a merger, acquisition, or sale of assets, information may transfer with the business. We will notify you of any change in ownership or use of your information.
6. Data retention
We keep personal information only as long as needed for the purposes described in this policy, to comply with legal and accounting obligations, or to resolve disputes. Inquiry emails are typically kept for up to 24 months. Account data is kept while your account is active and for a reasonable period after deletion to handle any final billing or disputes. Diagnostic logs are kept for up to 90 days.
7. Security
We use industry-standard safeguards — encryption in transit (HTTPS/TLS), access controls, and limited internal access on a need-to-know basis — to protect your information. No method of transmission or storage is 100% secure, but we work hard to protect your data and to notify you promptly if a breach ever affects you.
8. Your rights and choices
Depending on where you live, you may have the right to:
- Access the personal information we hold about you.
- Correct information that is inaccurate or incomplete.
- Delete your personal information.
- Object to or restrict certain processing, or withdraw consent where processing relies on it.
- Request a portable copy of your information.
- Lodge a complaint with your local data protection authority.
To exercise any of these rights, email us at hello@musicalism.com. You can also delete your App account at any time from the App’s settings screen, which removes your account data from our active systems within 30 days.
9. Children's privacy
The Services are intended for businesses and adults. We do not knowingly collect personal information from children under 13 (or under 16 in the EEA/UK). If you believe a child has provided us with personal information, contact us and we will delete it.
10. International transfers
Musicalism is based in the United Arab Emirates and works with service providers in other countries, including the European Union and the United States. When we transfer personal information across borders, we rely on appropriate safeguards such as standard contractual clauses to protect your information.
11. Third-party links
Our Services may link to third-party websites or services (for example, a streaming service or a venue website). We are not responsible for the privacy practices of those third parties, and we encourage you to read their privacy notices.
12. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. If the changes are material, we will provide a more prominent notice (for example, through the App or by email).
